These Terms of Use and End User License Agreement (collectively, the “Agreement”) form a legally binding agreement between you (“you”, “your”, or “user”) and Brushmo Inc. (“Brushmo”, “we”, “us”, or “our”) regarding your access to and use of the Brushmo AI mobile application (the “App”).
Please read this Agreement carefully before using the App. By accessing or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of this Agreement, you must not access or use the App.

1. Changes to This Agreement

We may update this Agreement at any time. Material changes will be communicated via the App or your account email. Continued use after such updates constitutes your acceptance.

2. Eligibility

You must be at least 13 years old to use the App. If under 18, you must use it with parent or guardian consent. Use is prohibited for those under 13.

3. General Use and License

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

  • Reverse engineer or exploit the App’s features;
  • Use the App for illegal or harmful purposes;
  • Disrupt or interfere with App operation or data.

4. Account and Registration

Account creation may be required for access to core features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

5. App Functionalities

Brushmo provides the following tools and services:

  • Teeth Scan – Plaque distribution analysis using image processing.
  • Food Scan – Cariogenic food and drink evaluation.
  • Product Scan – Compatibility analysis for oral care products.
  • Treatment Plan Decoder – Explanation of dental procedure codes.
  • Dental AI Assistant – Chat-based tool that provides general guidance on oral care, personalized product suggestions, and educational support.
  • Brushmo Shop – In-app marketplace offering curated oral care products for purchase.

6. Use of Dental AI Assistant

The Brushmo AI Assistant is a conversational system that uses artificial intelligence to provide educational content, general oral care guidance, and non-diagnostic suggestions. By using the AI Assistant, you acknowledge and agree that:

  • It does not provide medical or dental diagnoses or treatment.
  • It is not a substitute for advice from a licensed dental or healthcare provider.
  • Any actions taken based on AI-generated responses are at your own risk.
  • We do not guarantee the accuracy or completeness of AI outputs.
    You agree not to rely solely on the AI Assistant for decisions that affect your dental health.

7. E-Commerce and Product Purchase Terms

The Brushmo Shop enables users to browse and purchase oral care products. By purchasing through the App, you agree to the following:

  • Product Availability: We may modify or discontinue products at any time without notice.
  • Pricing: Prices are in USD and subject to change. Applicable taxes and shipping fees will be displayed at checkout.
  • Payment: All transactions are processed via secure third-party payment providers. You agree to provide valid billing information and authorize us to charge the full amount.
  • Shipping: Estimated delivery times are provided at checkout. Delays may occur due to external carriers.
  • Returns & Refunds: Refunds and returns are subject to our Return Policy and must be requested within the return window noted at purchase.
  • Third-Party Products: Some items may be sold or fulfilled by third-party vendors. In such cases, additional terms may apply, and Brushmo is not liable for third-party fulfillment or product performance.

8. Subscription & Payment Terms

Some features may require a paid subscription. Terms include:

  • Automatic renewal unless canceled 24 hours before renewal.
  • Payment is processed through your app store account.
  • Uninstalling the App does not cancel the subscription.
  • We reserve the right to adjust pricing or offerings.

9. Intellectual Property

All content, trademarks, and technology used in the App are owned by or licensed to Brushmo. You may not copy, reuse, or distribute this content without written permission.

10. User Content

You grant us a non-exclusive, royalty-free license to use content you upload (e.g., images of teeth, questionnaire answers) for analysis, service improvement, and personalized recommendations. We do not sell your personal content to third parties.

11. Third-Party Links

The App may link to third-party websites. Brushmo is not responsible for third-party content, services, or privacy practices.

12. Disclaimers

The App is provided "as is" and “as available.” We do not warrant that it will be uninterrupted or error-free. Your use of the App is at your own risk.

13. Medical Disclaimer

Brushmo does not provide medical or dental advice. All content and recommendations are informational only and not a substitute for professional evaluation. Always consult a licensed provider for oral health issues.

14. Limitation of Liability

To the fullest extent permitted by law, Brushmo is not liable for indirect, incidental, or consequential damages related to use of the App, AI assistant, or purchases made through the Brushmo Shop.

15. Termination

We may suspend or terminate your access at any time for violation of these Terms. Upon termination, your license to use the App ends immediately.

16. Legal Compliance

You represent that you are not subject to any U.S. government restrictions prohibiting App use.

17. Governing Law

This Agreement is governed by the laws of the State of California, USA. Any disputes shall be resolved exclusively in courts located in California.

18. Severability

If any term of this Agreement is deemed unenforceable, the rest of the Terms remain valid and enforceable.
